1. PLAYERS’ TERMS AND CONDITIONS

1.1. WEBSITE TERMS AND CONDITIONS (‘TERMS AND CONDITIONS’)

In these Terms and Conditions, ‘You’ or ‘Your’ or ‘User’ or ‘Player’ means any person who uses the Service or Software provided on or via any of Infiniza Limited Website/s. By using the Software, Services or Website, You signify Your agreement to these Terms and Conditions.

2. JURISDICTIONS

Online gambling may be illegal in the jurisdiction / country in which You are located. Infiniza Limited does not intend to enable You to contravene applicable law. You are responsible for any gaming activity and You are also responsible for ensuring that You are not contravening any law or legislation prohibiting online gambling. 3. YOUR ACCOUNT

3.1. MINIMUM AGE

All Users must be over the legal age of 18 years and in any case shall have attained the legal age as stipulated in their country of residence to register an account with Infiniza Limited. The Company absolutely prohibits minors or those underage from participating in any of the games or using the Services. We reserve the right to ask for proof of age from any Player and suspend their account until satisfactory documentation is provided. It is each Player’s responsibility to check that the laws in their state/country concerning gambling allow them to use Our Services prior to registration. Please refer to section 2 (Jurisdictions).

3.2. ACCOUNT

You must register personally for an account. You may only open and operate one single account. If You hold more than one account, we reserve the right to suspend Your accounts until all the account details and balances (belonging to You) are consolidated. Once completed, all other accounts will be terminated leaving one single active account.

3.3. PERSONAL INFORMATION

When registering, You must give a valid identification, address, contact e-mail or personal telephone number. All information supplied to Us must be accurate and complete in all respects. Infiniza Limited reserves the right to confirm Your address by posting an address verification letter to You or by contacting You via e-mail. All letter correspondence will be discreet and the envelope will not display any reference to Infiniza Limited. When such correspondence is initiated, all withdrawal requests will remain pending until the correspondence has been returned and approved by Us.

3.4. ACCURACY

You are asked to keep Your registration details up to date. If any details are inaccurate or requires updating, please contact Our Customer Support Team via Live Chat or by e-mailing support@mountgold.com.

3.5. ACTIVATION

All Users may be sent an e-mail or SMS to the registered e-mail address or phone number for account activation. If this is not verified, We reserve the right to suspend all activities on the account until the account details are successfully verified.

3.6. ACCEPTANCE

By registering an account, You are deemed to have accepted and understood all the Terms and Conditions displayed on Our Website. We recommend that all Players print out (or save to file) all transaction records, rules of play, cancellation policies, and pay-out policies. It is also recommended that You peruse the section related to game rules and regulation.

3.7. INACTIVE ACCOUNT

Accounts will become dormant after 12 months of inactivity. Any player with a balance will be contacted 30 days before the account goes dormant with a view to returning any remaining funds. Dormancy will be determined by the last time the Player logged in. Infiniza Limited will charge an inactive account fee not exceeding €5, or the currency equivalent, per month.

Should this not be possible, then the remaining balance (if any) within that account shall be remitted to the Malta Gaming Authority.

3.8. INTER-ACCOUNT TRANSFERS

The transfer of funds between individual accounts is strictly prohibited. Infiniza Limited prohibits players from selling, transferring and/or acquiring accounts to/from other players.

3.9. ACCOUNT SUSPENSION

Infiniza Limited reserves the right to refuse Your registration and to close or terminate Your account at its sole discretion. However, any contractual obligations already made will be honoured.

3.10. ACCOUNT CLOSURE

If You wish to close Your account, please follow the instructions on the Website or You can contact Our Customer Support Team via Live Chat or by emailing support@mountgold.com. Please be prepared to identify yourself via personal identification documentation.

3.11. RECOVERING OF FUNDS

If You wish to recover funds held in Your dormant, or excluded account, You are requested to contact Our Customer Support Team via Live chat or by emailing support@mountgold.com.

3.12. ACCOUNT SECURITY

As a Player, You are responsible in keeping secure Your account log in details, any linked e-mail address or mobile phone, and also the log in details of any personal computer or device on which You access Your account, such as having in place password protected devices, and locked screen when not in use, amongst others. Please note that the Company shall not be held responsible if there is any unauthorised use of Your account, when the Company itself is not at fault.

4. DEPOSITS AND WITHDRAWALS

4.1. DEPOSIT AND WITHDRAWAL METHODS

You may fund Your account via a variety of payment methods, including, but not limited to, Neteller, Skrill, Trustly, MuchBetter, Sofort, Bank transfer, Interac, or Zimpler. We may change these payment methods when necessary, and cannot guarantee that all payment options will be available at all times. Please note, country-specific restrictions can apply. This means certain payment methods will be available or unavailable to You, depending on where You are resident. We also have the right to accept or refuse payment methods depending on whether they fulfill certain conditions.

The minimum deposit is 10 EUR or 15 CAD. The maximum deposit depends on the payment method, but it normally ranges from 500 EUR/CAD to 5,000 EUR/CAD per transaction.

4.2. IDENTIFICATION CHECKS

The Company reserves the right to run checks on all players using third party vendors on the basis of the information provided at registration.

However, Infiniza Limited also reserves the right to ask You for verification documents upon deposits made or prior to executing a withdrawal. This includes, but is not limited to requesting copies of photographic identification documents, such as a Passport, Identity Card, or Driver's License; as well as requesting documents for confirming permanent residential address. At the very latest, the Company is obliged to request verification documents when You as a Player reaches EUR 2,000 in deposits.

4.3. WITHDRAWALS

Please note that all deposits should be wagered at least one time before You request a withdrawal. We reserve the right to charge 30% processing fee if the deposit is not wagered at least once.

Withdrawals are made payable only to the Player’s name that was used when registering on Our Website, which means that the payment method’s individual name must correspond to the Player’s gambling account name that was used on registration. Funds can only be withdrawn to the same payment method that was used for depositing, up to the amount of the deposit.

Withdrawals are processed within 72 hours of the request. However, Bank transfers and card transactions may take up to 3 working days, while e-wallet transfers are usually instant. Please note that certain withdrawals may experience a slight delay due to our identity verification process; however, this will not take longer than 5 days.

Should You wish to withdraw some or all of Your balance, You may select how much You wish to withdraw. The maximum withdrawal amount per 24-hour period is EUR 10,000 or currency equivalent.

4.4. IRREGULAR PLAY

Before any withdrawals are processed, Your play may be reviewed for any irregular playing patterns. In the interests of fair gaming, equal, zero or low margin bets or hedge betting, or exploitation of a game or game fault, shall all be considered irregular gaming for bonus play-through requirement purposes. Should the Company deem that irregular game play has occurred, Infiniza Limited reserves the right to withhold any withdrawals and/or confiscate all winnings.

5. REFUNDS

If You wish, You may request a deposit to be refunded back to the original payment method, provided that the funds from the said deposit are still available on Your account balance. Infiniza Limited reserves the right to charge a 5% (five percent) fee of the transactional value, but no less than 10 (ten) EUR or currency equivalent for administrative and processing fees of the refund. Such fees will be deducted from Your account balance and in case You do not have a balance on the account, the fees will be deducted from the amount to be refunded.

You acknowledge that refunds are done only in exceptional circumstances and processing of refunds is entirely at the Company’s discretion. Please note that any refund requests may experience a slight delay due to technical processing time; however, this will not take longer than 5 days.

6. BONUSES

6.1. SEPARATE TERMS AND CONDITIONS

All promotions, bonuses or special offers are subject to promotion-specific terms and conditions and any complimentary bonus credited to Your account must be used in adherence with such terms and conditions.

8. INTELLECTUAL PROPERTY

8.1. TRADEMARKS, SERVICE MARKS, TRADE NAMES

Infiniza Limited reserves all rights to the brand names relating to the Company, including but not limited to, .com and any other trademarks, service marks and/or trade names (the ‘Trade Marks’) used by the Company. By using the Software, Services or Website/s, You hereby acknowledge that You obtain no rights in the Trade Marks or the content, and You may only use the same in complete accordance with these Terms and Conditions.

8.2. USER GENERATED CONTENT

The Software, Services or Website may contain functionality whereby the User may post or publish text, images, videos or other copyright protectable material (‘User Generated Content’). By posting or publishing User Generated Content, You warrant that You have acquired any and all rights necessary for Your and Infiniza Limited’s use and reproduction of such User Generated Content.

In addition, You hereby grant to Infiniza Limited a license to use User Generated Content for the purposes contemplated by these Terms and Conditions, and You shall indemnify and keep Infiniza Limited harmless from and against any third party claims relating to the Company’s use of User Generated Content (or part thereof).

Infiniza Limited reserves the right to remove any User Generated Content which (in Our view) risks infringing third party rights, these Terms and Conditions, or applicable law.

9. USE OF AUTOMATED PLAYERS (‘BOTS’) AND ILLEGAL SOFTWARE

9.1. ILLEGAL SOFTWARE AND BOTS

The use and abuse of a bug or bots or any other form of artificial intelligence in any of the Software or Services provided by Infiniza Limited is illegal.

9.2. NON-PERMITTED SOFTWARE

The use of Software to influence or modify the outcome of any of the games offered by the Company or for player collusion for financial gain is strictly forbidden. Any monies acquired in this way will be deducted from the Player’s funds.

9.3. LEGAL PROCEEDINGS

Infiniza Limited shall take all necessary measures in case any of the illegal activities previously outlined in section 9.1 and 9.2 are performed by any Player. This includes, but not limited to, blocking of the Player’s account and freezing of the Player’s funds. The Company reserves the right to undertake legal proceedings against any individual found to have breached the rules under this section.

10. INTERRUPTIONS, LIMITATION OF LIABILITY, DISCLAIMER OF WARRANTIES, ETC

10.1. INTERRUPTIONS

Infiniza Limited is not liable for any downtime, server disruptions, lagging, or any technical or political disturbance to the game play. The Company shall not be held liable for any acts or omissions made by Your internet service provider or any third party with whom You have contracted to gain access to the server that hosts the Website.

10.2. LIMITATION OF LIABILITY

Subject to Infiniza Limited wilful misconduct or gross negligence, and to the maximum extent permitted by law, the Company is only liable for direct damages caused due to Infiniza Limited negligence and not for any indirect damages arising out of and in any way connected with Your use of, or inability to use the Software, Services or Website/s. Notwithstanding anything to the contrary, nothing in these Terms and Conditions shall exclude or limit Infiniza Limited liability for fraud, death or personal injury.

10.3. DISCLAIMER OF WARRANTIES

Unless otherwise specified in these Terms and Conditions and to the maximum extent permitted by law, the Software, Services and Website/s are provided on an ‘as is’ and ‘as available’ basis, and Infiniza Limited makes no warranties or representations, whether express or implied (whether by law, statute or otherwise) including but not limited to implied warranties and conditions of merchantability, satisfactory quality, fitness for a particular purpose, completeness or accuracy of the Software/Services or infringement of applicable laws and regulations.

Infiniza Limited makes no warranty that the Software or Services will meet Your requirements, be uninterrupted, timely, secure or error-free, that defects will be corrected or that the Software or server that makes it available are free from viruses or bugs or represents that the full functionality, accuracy and reliability of the Software or Services as to results or accuracy of any information obtained by You.

In the event of systems or communications errors relating to the generation of random numbers, bet settlement or other element of the Services, We will not be liable to You as a result of any such errors and we reserve the right to void all bets on the draws in question.

10.4. MISCARRIED AND/OR ABORTED GAMES

In the event of miscarried and/or aborted games, the game is terminated, all wagers are void and the amount of the wager is refunded to Your account.

10.5. SYSTEMS MALFUNCTION

Where a manifest error, mistake or system failure results in an incorrect paytable, any applicable bet/s are void and the original amount in relation to the bet/s will be returned back to the Player.

10.6. LIMITATION ON WAGERS

We reserve the right to refuse or limit any wager(s) at Our sole discretion for any reason whatsoever. In circumstances where a stake is deemed to be or is declared void by Us at Our discretion, any sum deducted from Your account with respect to that stake or wager shall be credited to Your account. Wagers shall only be valid if accepted by Our server and subject to Your agreement. 12. AVAILABILITY OF OFFERS

12.1. ELIGIBILITY

All Player offers are limited to one per person, family, household address, email address, telephone number, same payment account number and shared computer, for example public workplace. 12.2. OFFER RECALL

We reserve the right to reclaim all bonuses awarded and any winnings accrued if Players are found to be tampering with or abusing any aspect of the Company’s promotion/s. Where there is evidence of a series of bets placed by a Player or group of Players, which due to enhanced payments through promotional offers result in guaranteed Player profits irrespective of the outcome, the Company reserves the right to ignore the bonus element of such offers and settle bets at the correct odds. 14. RESPONSIBLE GAMING

14.3. SELF-EXCLUSION POLICY

Should You wish to self-exclude from Your account, You may do so directly from Your account settings by selecting the desired time period. 14.4. REALITY CHECK

Infiniza Limited will endeavour to resolve all disputes in a timely and responsible manner. The Company aims to communicate the complaint resolution to You within 10 working days from when You submitted the complaint to Us.

In special circumstances the complaint may have to be escalated and analysed at a more senior level. In this case, We will inform You of the reason for extension before the first 10 working days elapse, and that the response may be extended by no more than another 10 working days. However, to the extent permitted by applicable law, any dispute arising out of Your use of the Services shall be finally settled by the Alternative Dispute Resolution body. However, the Company encourages Players to first exhaust Our complaints procedure.

17.1. ALTERNATIVE DISPUTE RESOLUTION (ADR) BODY

In the case where any complaint or dispute has not been solved to Your satisfaction, You have the right to lodge Your complaint with:

Players have the option of lodging a dispute with the ADR entity free of charge. Please be awaree that Infiniza Limited is not a financial institution and thus any deposits made into Your account are not due any interest payments on the deposit(s) whatsoever.

18.2. NO LEGAL OR TAX ADVICE

Infiniza Limited does not provide advice to Players regarding tax and/or legal matters. Players who wish to obtain advice regarding tax and legal matters are advised to contact appropriate advisors and/or authorities in the jurisdiction in which they are domiciled and/or resident.

19. NO ARBITRAGE

Players are strictly prohibited from utilising Infiniza Limited and its systems to facilitate arbitrage through Currency Exchange transactions. Where Infiniza Limited deems that a Player has deliberately used the aforementioned systems for financial gain through arbitrage, any gains will be forfeited and deducted from the Player’s balance without warning or notification.

20. AGAINST MONEY LAUNDERING AND TERRORIST FINANCING

Players are strictly prohibited from utilising Infiniza Limited and its systems to facilitate any type of illegal money transfer system. Infiniza Limited will conduct 'know your customer’ (‘KYC’) controls as required under the applicable law.

You must not use the Software, Services or Website for any unlawful or fraudulent activity or prohibited transaction (including money laundering and terrorist financing) under the laws of any jurisdiction that applies to You. It is unlawful to deposit money from ill-gotten means and the Company undertakes checks on all transactions to prevent money laundering and terrorist financing activities.

If the Company has a suspicion that You may be engaging in or have engaged in fraudulent, unlawful or improper activity, including, without limitation, money laundering or terrorist financing activities, or conduct activities otherwise in violation of these Terms and Conditions, We will comply with all Our responsibilities under applicable anti-money laundering and anti-terrorism financing laws. This includes, but is not limited to terminating Your access to the Website immediately and/or blocking Your account.

If Your account is terminated or blocked in such circumstances, the Company is under no obligation to refund You any funds that may be in Your account. In addition, Infiniza Limited shall be entitled to inform relevant authorities of Your identity and of any suspected unlawful, fraudulent or improper activity or transactions.

21. OTHER

21.1. ACCEPTANCE

By accepting these Terms and Conditions, You are fully aware that there is a risk of losing money when gambling on the Website and that You are fully responsible for any such loss. In relation to Your losses, You shall have no claims whatsoever against Infiniza Limited or their respective directors, officers or employees.

21.2. NON-ELIGIBLE PLAYERS

Employees of Infiniza Limited, including its licensees, advertising and promotion agencies, media partners, game providers, other suppliers, and members of the immediate families of each are not eligible to participate in any of the games available on the Website.

21.3. TERMINATION OF ACCOUNT

Infiniza Limited reserves the right to cancel Your account for any reason whatsoever at any time without notice to You. Any balance in the Your account at the time of such cancellation will be credited to Your original payment method account and/or sent to You by bank transfer.

However, Infiniza Limited reserves the right, in its unfettered discretion, to void any winnings and confiscate any balance in Your account in any of the following circumstances:

  • If You have more than one active account for the Services on the Website;
  • If the name on Your gambling account does not match the name on the payment account(s) used to make deposits on Your account;
